Same-Sex Marriage Recognition Abroad: Can Your Spouse Move With You?

Journal · Both editions · Data as of 1 August 2026 (Retiree) and 17 October 2026 (Digital Nomad)

The short answer

Same-sex marriage recognition abroad is strong across most countries we cover: a valid US marriage is generally recognized, and Portugal, Spain, Canada and Uruguay plainly include same-sex spouses on residence routes. Croatia records it as a life partnership, Italy as a civil union, and Panama not at all.

Same-sex marriage recognition abroad decides more than whether your wedding counts. It decides whether your spouse can join you on your visa, inherit from you, make medical decisions and share your residence status. A valid US marriage travels well to most of the countries Out & Found covers, but not to all of them, and visa rules often say less than marriage law does.

Is my US marriage valid abroad?

Where same-sex marriage is legal, a valid foreign marriage is generally recognized. Three countries we cover handle it differently:

  • Croatia records it as a life partnership, with broadly marriage-equivalent effects.
  • Italy treats it as a civil union under Law No. 76/2016, with many marriage-like effects.
  • Panama does not register it, and offers no civil union either.

Before you move, order an apostilled copy of your marriage certificate from the state that issued it, and budget for a certified translation where the country requires one.

Bringing a same-sex spouse on your visa

Family reunification is where marriage law turns practical. Portugal and Spain state plainly that same-sex spouses and civil partners qualify. Canada recognizes same-sex spouses and common-law partners after a year together, though each partner needs separate work authorization. Uruguay's rule is relationship-based rather than gender-specific. In many other countries the visa rules are silent, which is not the same as a refusal; ask the consulate in writing and keep the reply with your file. Our nomad visa comparison adds what each partner costs in extra income.

Unmarried partner visas

Options shrink quickly without a marriage certificate. Portugal and Spain accept unmarried partners with documentary proof of the relationship, Uruguay recognizes concubines (unmarried partners), and the Netherlands accepts a separate application showing a durable relationship. Canada counts common-law partners after a year of living together. Greece, Germany, France, Panama and Thailand offer no clear route. For many couples, marrying before the move is the simplest way to keep the family together on one application.

Civil union countries and what changes

A civil union or life partnership usually covers residence, inheritance and medical decisions, but not always adoption, and rules differ from marriage in small ways that matter later. In Ecuador, adoption is excluded for same-sex couples even with marriage. In Italy, civil-union partners are taxed like spouses on inheritance. If you have children or plan to, read the family-recognition section of the guide before you choose.

Retiring abroad as a married same-sex couple

For retirees, a recognized marriage can lower the cost of the visa itself. Costa Rica's Pensionado covers a spouse on the same application, Ecuador's Jubilado visa asks US$1,696 for a couple on one pension, and Greece raises its figure to €4,200 a month with a dependent partner. Panama's Pensionado is cheap, but a same-sex partner cannot join as your spouse there. See the retirement visa comparison, or filter the Country Finder for marriage equality.
